Ausgangangssituation
Mexiko erkennt die Menschenrechte in seiner Verfassung und vielen Gesetzen an. Das Land hat in den vergangenen Jahren bereits bedeutende rechtliche und institutionelle Fortschritte erzielt. Doch die Justiz steht weiterhin in der Kritik: Zwischen 1994 und 2020 gab es mehr als 1.500 internationale Appelle an die Bundesjustiz wegen Vorwürfen von Folter, gewaltsamem Verschwindenlassen, Gewalt gegen Frauen und fehlendem Zugang zu Rechtsmitteln.
Die Menschenrechte in der Justiz einzuhalten und entsprechende internationale Standards zu gewährleisten, steuert besonders dazu bei, die Menschenrechtslage in Mexiko zu verbessern. Um dies zu erreichen, sind verlässliche Daten und ein systematisches Monitoring notwendig. Öffentliche Berichte zur Situation sowie zu Ergebnissen und Wirkungen der Maßnahmen tragen zu Transparenz und Dialog bei.

Ziel
Die mexikanische Bundesjustiz hält Menschenrechtsverpflichtungen sowie -standards besser ein.

Vorgehensweise
Das Vorhaben hat eine Methodik zur Entwicklung von Indikatoren für die mexikanische Bundesjustiz erarbeitet. So misst es beispielsweise anhand von Folter und Gewalt gegen Frauen menschenrechtsrelevante Aspekte sowie gerichtliche Entscheidungen in der Bundesjustiz.
Im Rahmen erster Pilotprojekte prüft das Vorhaben die Messbarkeit der Indikatoren auf Grundlage der im Justizsystem vorliegenden Informationen. Anschließend beurteilt es, inwiefern zusätzliche interne Daten erhoben oder externe Informationsquellen hinzugezogen werden. Die Erkenntnisse fließen in ein Monitoringsystem ein, das Umsetzung und Einhaltung internationaler Menschenrechtsstandards erfasst.
Zudem rücken informelles Lernen, neue Lern- und Austauschformate, Wissensforen und innovative Laboratorien die Bedarfe und Interessen des Justizpersonals in den Fokus und unterstützen den Transfer von der Theorie in die Praxis. Infografiken, didaktische Praxisanleitungen sowie neue Berichtsformate, besonders für die Zivilgesellschaft, sind ansprechend gestaltet. Dies baut Zugangshemmnisse ab und fördert Dialog und Transparenz.


 

Context.
Efforts of Mexico's Federal Judiciary Power to respond to 1,500 human rights recommendations.
International organizations periodically review compliance with international human rights treaties and obligations, and issue recommendations to improve compliance with International Human Rights Standards.
Between 1994 and 2020, Mexico’s Federal Judiciary Power (PJF) received approximately 1,500 human rights’ recommendations from international organizations. It is important to highlight that 800 recommendations were aimed at the training and awareness of judges and jurisdictional personnel.
With the constitutional reform of 2011, the Mexican State strengthened the respect for human rights’ fulfillment contained in international treaties to which Mexico is a signatory. Progress was also made in the development of investigation protocols on torture and forced disappearance, and in the implementation of activities to promote respect for human rights, such as the General Law on Victims and the National Law on Criminal Execution.
With the project "Strengthening Federal Justice for Human Rights in Mexico" (FORTAJUS-DH), the Council of the Federal Justice (CJF) and the German Agency for Sustainable Development (GIZ) in Mexico are pursuing the common goal of ensuring compliance with human to improve legal standards and recommendations in the practical work of judges and judicial staff, thereby strengthening the rule of law in Mexico.

Objective.

1. A strengthening of the internal control in the Judicial Power of the Federation improves the protection of human rights aned compliance with international human rights standards.
2. Accountability and transparency of the Mexican federal judicary are promoted thorugh a systematic measurment of human rights indicators.
3. The integrated perspective of the Mexican civil society and international organizations promotes intrasocietal and international dialogue for the protection of human rights thorugh the Judical Power of the Federation.


Approach.
Promote adherence to international standards on Human Rights
1. Increase the judges and jurisdictional personnel knowledge on human rights, as well as the creation of conditions for the application in the daily work and operational processes.
2. Generate human rights indicators based on recommendations for the CJF, which measure the level of fulfillment in terms of human rights obligations and recommendations through and institutionalized monitoring system.
3.Improve the PJF's information and reporting systems on the level of compliance with human rights for the Mexican public and international organizations.
A priority focus is on international recommendations and obligations for the prevention of gender-based violence and torture.

Specific Themes.

Situación de partida
México reconoce los derechos humanos en su Constitución y en muchas leyes. En los últimos años, el país ha realizado importantes avances desde el punto de vista jurídico e institucional. Sin embargo, el poder judicial sigue siendo objeto de críticas: entre 1994 y 2020, hubo más de 1 500 apelaciones internacionales a la justicia federal por denuncias de tortura, desapariciones forzadas, violencia contra las mujeres y falta de acceso a posibilidades de recurso.

El respeto de los derechos humanos en el poder judicial y el cumplimiento de los estándares internacionales correspondientes contribuyen sobre todo a mejorar la situación de los derechos humanos en México. Para lograrlo, se requieren datos fiables y un seguimiento sistemático. Los informes públicos sobre la situación y sobre los logros y resultados de las medidas contribuyen a fomentar la transparencia y el diálogo.

Objetivo
La justicia federal mexicana cumple en mayor medida las obligaciones y estándares en materia de derechos humanos.

Procedimiento
El proyecto ha elaborado una metodología destinada al desarrollo de indicadores para la justicia federal mexicana. Por ejemplo, se basa en la tortura y la violencia contra las mujeres para medir aspectos relevantes para los derechos humanos, así como las decisiones judiciales del sistema de justicia federal.

En el marco de proyectos piloto iniciales, el proyecto comprueba hasta qué punto son cuantificables los indicadores a partir de la información disponible en el sistema judicial. A continuación, evalúa en qué medida se recopilan datos internos adicionales o se consultan fuentes de información externas. Los hallazgos se integran en un sistema de seguimiento que registra la implementación y el cumplimiento de los estándares internacionales en materia de derechos humanos.

Asimismo, el aprendizaje informal, los nuevos formatos de aprendizaje e intercambio, los foros de conocimiento y los laboratorios innovadores se centran en las necesidades e intereses del personal del sistema judicial y apoyan la transferencia de la teoría a la práctica. Las infografías, las guías prácticas didácticas y los nuevos formatos de informes, especialmente para la sociedad civil, tienen un diseño atractivo. De esta forma, se eliminan los obstáculos para el acceso y se fomenta el diálogo y la transparencia.
