Ausgangssituation
Die marokkanische Politik steht seit Jahren vor politischen, wirtschaftlichen und gesellschaftlichen Herausforderungen. Der Druck auf die Politik hat im Zuge des „Arabischen Frühlings" noch einmal zugenommen. Um den Herausforderungen zu begegnen, sind bereits zahlreiche Reformen erfolgreich auf den Weg gebracht worden. Insbesondere im Bereich des Reformmanagements und der nationalen Koordination bedarf es jedoch weiterer Fortschritte, damit den Forderungen nach mehr politischer Partizipation nachgekommen werden kann und das wirtschaftliche Wachstum einen Beitrag zur Überwindung von Armut leisten kann.
Der Umbruch in der MENA-Region und der Reformwille des Königs, der sich durch die 2011 verabschiedete neue Verfassung bestätigt hat, eröffnen neue Spielräume und Bedarfe zur Unterstützung in ordnungs- und strukturpolitischen Fragen. Die technische Zusammenarbeit kann mit strukturbildenden Maßnahmen den Aufbau dauerhaft tragfähiger legitimer staatlicher Strukturen und handlungsfähiger Institutionen und konstruktiver Beziehungen zwischen Staat und Gesellschaft unterstützen.
Ziel
Die marokkanische Regierung gestaltet politische, wirtschaftliche und soziale Reformprozesse transparent und partizipativ und setzt sie besser um.
Vorgehensweise
Auf Grundlage von Anträgen der marokkanischen Partner erbringt der Fonds methodische, fachliche und finanzielle Beratungs- und Unterstützungsleistungen zur Verbesserung ordnungs- und strukturpolitischer Grundlagen, zu demokratischen Transformationsprozessen sowie zur Stärkung und Mobilisierung reformorientierter Kräfte in Marokko. Dies geschieht in Zusammenarbeit mit verschiedenen Ministerien, anderen staatlichen Institutionen und weiteren deutschen und marokkanischen Kooperationspartnern.
Wirkungen
Der struktur- und ordnungspolitische Beratungsfonds ist ein flexibles Instrument, um auf politischer Ebene Hebelwirkungen für Reformen zu erzielen. Er engagiert sich zurzeit bei wirtschaftspolitischen Reformen, bei der Entwicklung des Geschäftsklimas, bei der Stärkung des Datenschutzes und bei der lokalen Regierungsführung.
Entscheidende Fortschritte wurden mit der Maßnahme „Auto-Entrepreneur" erzielt, einer abgewandelten Version der Ich-AG, die vielen informellen Kleinunternehmern den Übergang in die formelle Wirtschaft ermöglicht. Durchgeführt wurde die Maßnahme in enger Kooperation mit dem Ministerium für Industrie, Handel, Investitionen und digitale Wirtschaft und der ihm nachgeordneten nationalen Agentur zur Förderung kleiner und mittlerer Unternehmen.
Die mit Unterstützung der Maßnahme erarbeitete Gesetzesvorlage für die Auto-Entrepreneurs wurde bereits kurz nach dem Amtsantritt der neuen Regierung im November 2013 vom Kabinett beschlossen. Inzwischen hat der Gesetzesentwurf alle Instanzen des Gesetzgebungsverfahrens durchlaufen. Anfang 2015 haben sich die ersten Auto-Entrepreneurs registriert und damit von umfangreichen Vorteilen profitieren können, zum Beispiel von vereinfachter Besteuerung, Sozialversicherung, Zugang zu Informationssystemen, Mikrokrediten und anderem.
 

Context
Policy-makers in Morocco have been confronted with political, economic and social challenges for many years now, and pressure has intensified even further in the wake of the Arab Spring. Numerous reforms have already successfully been initiated to address these challenges. However, additional progress must be made, particularly in the areas of reform management and national coordination, to ensure that demands for greater political participation can be met and economic development can contribute to overcoming poverty.
The transformation that has occurred in the MENA region along with the King of Morocco’s willingness to promote reforms – confirmed in the new constitution that was signed in 2011 – have opened up new possibilities and created an altered set of needs with regard to regulatory and structural policy support. Technical cooperation paired with structural measures can contribute to establishing sustainable and legitimate state structures, capable institutions and constructive relations between the state and society.

Objective
The Moroccan Government takes a transparent and inclusive approach to shaping political, economic and social reform processes and implements these reforms more effectively.

Approach
The fund provides methodological, technical and financial advisory and support services on the basis of requests made by the Moroccan partner. These services are aimed at improving regulatory and structural policy frameworks, democratising processes of transformation, and strengthening and mobilising reform-oriented forces in Morocco. This work is carried out in cooperation with various ministries, state institutions and additional German and Moroccan partners.

Results
The Fund for Regulatory and Policy Advice is a flexible instrument that aims to generate wide-ranging leverage effects for reforms at the political level. The fund has been utilised for activities such as developing social entrepreneurship, providing advisory services on migration, reforming consumer and data protection policies, and supporting participatory budgeting in the city of Nador.
Decisive progress was achieved through a measure known as ‘Auto Entrepreneur’, a variation of the German Ich AG (one-person company) concept. This measure is being carried out in close cooperation with the Moroccan Ministry for Industry, Trade, Investment and the Digital Economy and its subordinate National Agency for the Promotion of Small and Medium Enterprises.
The legislative bill for ‘auto entrepreneurs’ – drafted with the support of this project – was passed by the cabinet shortly after the new administration took office in November 2013. Since then, the bill has made further progress and was delivered to the Government’s General Secretariat, which is responsible for legislative procedures. At the same time, the Moroccan Government is pushing forward with the implementation strategy. The first ‘auto entrepreneurs’ are expected to be able to register under this designation starting in early 2015, at which point they will be able to benefit from a wide range of advantages such as simplified taxation, social security, access to information systems, microloans and more.
 

Situation initiale
La politique marocaine est confrontée depuis des années à des défis d’ordre politique, économique et social. Dans la foulée du « printemps arabe », la pression qui s’exerce sur le pouvoir politique s’est encore accentuée. Pour relever ces défis, de nombreuses réformes ont déjà été engagées avec succès. Toutefois, notamment en ce qui concerne la gestion de la réforme et la coordination nationale, des progrès doivent encore être réalisés afin de pouvoir satisfaire les aspirations à plus de participation citoyenne et pour que la croissance économique contribue réellement à la réduction de la pauvreté.
Les bouleversements politiques dans la région MENA et la volonté de réforme du roi marocain, qui s’est confirmée au travers de la nouvelle Constitution votée en 2011, ouvrent de nouvelles opportunités et besoins en termes d’appui sur des questions de politique structurelle et réglementaire. Au travers de mesures de développement structurel, la coopération technique peut promouvoir l’émergence de structures étatiques légitimes et viables sur le long terme, d’institutions performantes et de relations constructives entre l’État et la société.

Objectif
Le gouvernement marocain gère les processus de réformes politiques, économiques et sociales de manière transparente et participative, et les met en œuvre avec plus d’efficacité.

Approche
Intervenant sur la base de requêtes transmises par les partenaires marocains, le fonds propose des prestations de conseil et d’appui d’ordre méthodologique, technique et financier pour améliorer les bases de la politique réglementaire et structurelle, promouvoir des processus vers une transition démocratique, mais aussi renforcer et mobiliser les forces de réforme et de progrès au Maroc. Ce travail s’opère en coopération avec différents ministères, d’autres institutions gouvernementales ainsi que d’autres partenaires de coopération allemands et marocains.

Résultats
Le Fonds flexible de Consultation en Politique structurelle et réglementaire est un instrument souple apte à induire au niveau politique un effet de levier en faveur de réformes. Il s’investit par exemple pour le développement de l’entrepreneuriat social, le conseil en politique migratoire, la réforme de la protection du consommateur et des données personnelles de même que pour l’élaboration participative du budget citoyen dans la ville de Nador.
Des progrès décisifs ont été réalisés grâce à l’action de soutien aux auto-entrepreneurs. Cette mesure est mise en œuvre en étroite liaison avec le Ministère de l’Industrie, du Commerce, de l’Investissement et de l’Économie numérique et son Agence nationale pour la promotion de la petite et moyenne entreprise.
La proposition de loi sur les auto-entrepreneurs élaborée avec l’appui du projet a été approuvée par le Conseil des ministres en novembre 2013, peu de temps après l’entrée en fonction du nouveau gouvernement. Depuis lors, après avoir franchi de nouveaux obstacles, le projet de loi a été déposé au Secrétariat général du gouvernement en charge du pilotage de la procédure législative. Parallèlement, le gouvernement marocain travaille d’arrache-pied au parachèvement de sa stratégie de mise en œuvre. Il est prévu que les premiers auto-entrepreneurs pourront se faire enregistrer comme tels dès début 2015 et profiter ainsi de toute une série d’avantages, comme par exemple un régime fiscal simplifié, le droit à la sécurité sociale, l’accès aux système d’information, microcrédits et autres facilités.
