Ausgangssituation
Kolumbien ist ein Land mit zwei Gesichtern: Stetiges Wirtschaftswachstum, eine wachsende Mittelklasse in modernen Großstädten, Ressourcenreichtum, eine stabile und international ausgerichtete Wirtschaftspolitik stehen der extremen sozialen Ungleichheit gegenüber, die seit mehr als 50 Jahren einen bewaffneten Konflikt befeuert, der täglich Menschenleben fordert.
Trotz Fortschritten bei der Bereitstellung staatlicher Leistungen besteht eine permanente humanitäre Krise: Das nationale Register für Opfer des bewaffneten Konfliktes hat mittlerweile mehr als 8,6 Millionen Opfer registriert. In diesem Kontext stellt das Gesetz zur Opferentschädigung und Landrückgabe von 2011 eines der ambitioniertesten Gesetzesvorhaben der kolumbianischen Regierung dar. Nach mehr als vier Jahren Verhandlungen, unterzeichneten die nationale Regierung und die ehemalige Guerrilla Fuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo (FARC-EP) im November 2016 ein Friedensabkommen. Die FARC-EP hat die Waffen niedergelegt und sich als politische Partei neu konstituiert. Gleichzeitig liefen seit Februar 2017 bis Januar 2019 offizielle Verhandlungen zwischen der kolumbianischen Regierung und der zweitgrößten Guerrilla, dem Ejército de Liberación Nacional (ELN).
Kolumbien ersuchte 2004 die Organisation Amerikanischer Staaten (OEA) um eine Unterstützung des Friedensprozesses in Kolumbien. Auf dieser Grundlage entstand die Mission der Organisation Amerikanischer Staaten zur Unterstützung des Friedensprozesses in Kolumbien (MAPP/OEA). Anfangs begleitete sie als internationale Friedensmission den Prozess „Gerechtigkeit und Frieden". 2010 wurde das Mandat auf die Begleitung der Prozesse der Landrückgabe und der Umsetzung des Gesetzes für „Opfer und Landrückgabe" ausgeweitet.
In ihrem aktuellen Mandat (2017-2022) fördert die Mission die Friedensentwicklung in den Regionen, unterstützt das Monitoring der Friedenspolitiken (Gesetz „Gerechtigkeit und Frieden", Gesetz der „Opferentschädigung und Landrückgabe", etc.) und soll zu deren Weiterentwicklung beitragen. Das Hauptziel der Mission liegt darin Inzidenz in der Gestaltung und Implementierung der Friedenspolitiken zu erzielen, über die Beobachtung und Analyse der territorialen Kontexte konkrete Informationen für die Entscheidungsfindung zu liefern und zur Stärkung der staatliche Kapazitäten beizutragen.

Ziel
Die Mission der Organisation Amerikanischer Staaten zur Unterstützung des Friedensprozesses in Kolumbien ist in ihrer Arbeit für den Opferschutz finanziell gestärkt und leistet einen wichtigen Beitrag zur Berarbeitung des Gewaltkonfliktes, insbesondere in Bezug auf das Monitoring und die regionale Umsetzung des Friedensvertrages.

Vorgehensweise
Um der Mission der Organisation Amerikanischer Staaten zur Unterstützung des Friedensprozesses die Arbeit zu ermöglichen, zahlt die Internationale Gemeinschaft in einen Fonds ein. 2018 haben außer Deutschland, Kanada, Korea, Norwegen, die Niederlande, Großbritannien, Spanien, Schweden, die Schweiz, die USA, und die Türkei in den Fonds eingezahlt. Aus den Geldern des Fonds wird das allgemeinde Mandat der MAPP/OEA und alle damit verbundenen Aktivitäten unterstützt. Es besteht ein Finanzierungsvertrag zwischen dem BMZ und MAPP/OEA.
Seit 2015 wird der finanzielle Beitrag direkt in diesen Fonds (basket fund) eingespeist. Der deutsche Beitrag lag 2018 bei einer Millionen Euro. Damit erhöht sich der deutsche Gesamtbeitrag seit Beginn der Laufzeit des Projektes im Jahr 2008 auf 6.5 Millionen Euro.

Wirkungen
Die Mission hat sich als strategischer Akteur im Prozess der lokalen, regionalen und nationalen Friedenskonstruktion positioniert. Ihre Arbeit wird von der kolumbianischen Regierung sehr geschätzt, was sich an der Mandatsverlängerung zeigt. Die Arbeit der Mission konzentriert sich im aktuellen Mandat auf die folgenden drei Themenblöcke, in denen wesentliche Fortschritte erreicht werden konnten.
Friedenskonstruktion: Individuelle und kollektive Opfer des bewaffneten Konfliktes (vor allem ethnische Gemeinschaften und Kleinbauen und -bäuerinnen), verfügen über verbesserten Zugang zu ihren Land- und Entschädigungsrechte.
Staatliche Institutionen und lokale Initiativen sind im Bereich der Friedenspädagogik und der friedlichen Konflikttransformation gestärkt.
Zivilgesellschaftliche Organisationen haben an den Verhandlungen der kolumbianischen Regierung mit der Guerrillagruppe Ejercíto de Liberación Nacional (ELN) teilgenommen. An der Erarbeitung dieser partizipativen Methode war die Mission massgeblich beteiligt.
Transitionsjustiz: Die staatlichen Institutionen, die mit der Transitionsjustiz beauftragt sind, verfügen über konkrete Instrumente für die Umsetzung des integralen Systems der Wahrheit, Gerechtigkeit, Entschädigung und Nicht-Wiederholung sowie über Empfehlungen für den Abschluss der Prozesse unter dem Gesetz Gerechtigkeit und Frieden. Die Mission hat dazu mit strategischen Dokumenten mit wichtigen Beobachtungen und Empfehlungen zur Umsetzung der Instrumente der Transitionsjustiz und Makrokriminalität, beigetragen.
In fünf nationalen Dialogforen für die intergerichtliche Koordinierung diskutieren Indigene Gemeinden und staatliche Institutionen die Stärkung und Anwendung der indigenen Gerichtsbarkeit sowie die Angleichung mit der konventionellen Gerichtsbarkeit und der Transitionsjustiz.
Entwicklungen und Dynamiken in den Regionen: Die kolumbianischen Institutionen verbessern den Umgang mit der regionalen Sicherheitssituation in Regionen, in denen die Mission präsent ist., Darüberhinaus haben die Institutionen bessere Kenntnisse der territorialen, sozialen Konfliktivitäten und entwickeln effektivere Strategien für den Umgang mit diesen Konfliktivitäten. Beides ist möglich dank der regelmässigen Analyse- und Monitoring-Berichte, die die Mission für die Regionen erstellt, in denen sie aktiv ist.

Context
Colombia is a country with two faces: a steady economic growth, a growing middle class in modern cities, resource wealth, a stable economic policy with international orientation face the extreme social inequality, which fuels an armed conflict since more than 50 years, claiming human lives on a daily basis.
Despite the improvements in the provision of state services there still is a permanent humanitarian crisis: The national register of victims of the armed conflict by now has registered more than 8,6 million of victims. In this context, the Victims and Land Restitution Law from 2011 presents one of the most ambitious legislative proposals of the Colombian government. After more than four years of negotiation, the national government and the former guerrilla Fuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo (FARC-EP) in November 2016 signed a peace agreement. The FARC-EP laid down their arms and reconstituted as a political party. At the same time, from February 2017 until January 2019, official negotiations took place between the Colombian government and the second largest guerrilla, the Ejército de Liberación Nacional (ELN).

In 2004 Colombia asked the Organization of American States (OAS) to provide assistance for the country’s peace process. This request led to the establishment of the OAS Mission to Support the Peace Process in Colombia (Spanish acronym MAPP/OEA). In the beginning, the aim of this international peacekeeping mission was to support Colombia’s justice and peace process. In 2010, the mandate was extended to include support for the land restitution process and implementation of the Victims and Land Restitution Law.
During its current mandate (2017-2022), the mission promotes peace construction in the region, supports the monitoring of peace policies („Justice and Peace Law", „Victims and Land Restitution Law", etc.) and shall contribute to their development. The main objective of the mission is to obtain incidence on the design and implementation of peace policies, to provide concrete information for decision making by observation and analysis of territorial contexts and to contribute to the reinforcement of state capacities.

Objective
MAPP/OEA has more financial support for its victim protection work and is making an important contribution to the management of the violent conflict, especially regarding the monitoring and regional implementation of the peace agreement.

Approach
The international community pays into a fund to facilitate the work of MAPP/OEA. In 2018 funds were received from Canada, South Corea, Norway, the Netherlands, the UK, Spain, Sweden, Switzerland, the USA and Turkey as well as from Germany. This money is used to support MAPP/OEA’s general mandate and all the associated activities. BMZ has a financing agreement in place with MAPP/OEA.
Since 2015 financial contributions have been paid directly into this basket fund. Germany’s contribution in 2018 amounted to one million euros, thus taking the country’s total contribution since the project started in 2008 to 6.5 million euros.

Results achieved as far
The mission has positioned itself as a strategical actor in the process of local, regional and national peace construction. Its work is highly valuated by the Colombian government, which is reflected by the prolongation of its mandate. The work of the mission during its current mandate concentrates on the following three topics, in which significant porgress could be achieved.

Peace Construction:
Individual and collective victims of the armed conflict (especially ethnic communities and peasants) dispose of improved acces to their land and reimbursement rights.
State institutions and local initiatives are strengthend in the area of peace education and peaceful conflict transformation.
Civic organisations have participated in the negotiations between the colombian government and the guerrilla group Ejercíto de Liberación Nacional (ELN). The mission was significantly involved in the elaboration of this participative method.
Transitional Justice: The state institutions assigned with transitional justice dispose of concrete means for the implementation of the Integral System of Truth, Justice, Reparation and Non-Repitition, as well as of recomendations for the closing of the processes under the Justice and Peace Law. To this, the mission has contributed with strategical documents containing important observations and recomendations on the implementation of the means of transitional justice and macro-criminality.
In five national dialogue forums on inter-judicial coordination, indigenous communities and state institutions discuss the strengthening and application of indigenous jurisdiction, as well as the harmonisation with conventional jurisdiction and transitional justice.
Developments and dynamics in the regions:
The colombian institutions improved their handling of the security situation in the regions in which the mission is present. Furthermore, the institutions have improved knowledge about territorial, social conflictivities and develop effective strategies on handling this conflictivities. Either is possible due to the periodic analysis and monitoring reports, the mission produces about the regions in which it is active.

Contexto
Colombia es un país con dos caras: Un crecimiento continuo de la economía, una creciente clase media en grandes ciudades modernas, riqueza de recursos, una estabilidad política y una economía con orientación internacional contrastan con la desigualdad social extrema, que desde hace más de 50 años está enardeciendo a un conflicto armado, que está exigiendo vidas humanas diariamente.
A pesar de progresos en la provisión de servicios estatales, existe una crisis humanitaria permanente: El registro nacional de víctimas del conflicto armado hasta ahora ha registrado más de 8,6 millones de víctimas. En este contexto, la ley de reparación de víctimas y restitución de tierras de 2011 presenta uno de los proyectos de ley del gobierno colombino más ambicionados. Después de más de 4 años de negociaciones, en noviembre del 2016, el gobierno nacional y la antigua guerrilla de las Fuerzas Armadas Revolucionarias de Colombia-Ejército del Pueblo (FARC-EP) firmaron un acuerdo de paz. La FARC-EP entregó sus armas y se reconstituyó como partido político. Al mismo tiempo, desde febrero de 2017 hasta enero de 2019, se realizaban negociaciones oficiales entre el gobierno colombiano y la segunda guerrilla más grande, el Ejército de Liberación Nacional (ELN).
En 2004, Colombia solicitó apoyo a la Organización de los Estados Americanos (OEA) para el proceso de paz en Colombia. Sobre esta base, se creó la Misión de Apoyo al Proceso de Paz de la Organización de los Estados Americanos (MAPP/OEA). En el comienzo prestaba apoyo, en su calidad de misión de paz internacional, al proceso de Justicia y Paz. En 2010, el mandato fue ampliado para abarcar también el respaldo a los procesos de restitución de tierras y la aplicación de la Ley de Víctimas y Restitución de Tierras.
En su mandato actual (2017-2022), la misión promueve el desarrollo de paz en las regiones, apoya al monitoreo de las políticas de paz (Ley Justicia y Paz, Ley de Víctimas y Restitución de Tierras, etc.) y debe contribuir a su desarrollo. La meta principal de la misión es lograr incidencia en la elaboración e implementación de las políticas de paz, aportar informaciones concretas para la toma de decisiones mediante la observación y el análisis de los contextos territoriales, y contribuir al fortalecimiento de capacidades estatales.

Objetivo
Se ha brindado apoyo financiero a la Misión de Apoyo al Proceso de Paz de la Organización de los Estados Americanos en Colombia para su trabajo a favor de la protección de las víctimas. La misión contribuye de manera importante a la gestión del conflicto violento, especialmente respecto al monitoreo y la realización regional del acuerdo de paz.

Método
A fin de facilitar el trabajo de la Misión de Apoyo al Proceso de Paz de la Organización de los Estados Americanos, la comunidad internacional aporta recursos a un fondo de canasta. En 2018, aparte de Alemania, han contribuido a este fondo Canadá, Corea del sur, Noruega, los Países Bajos, Gran Bretaña, España, Suecia, Suiza, los Estados Unidos y Turquía. Los recursos del fondo respaldan el mandato general de la MAPP/OEA y todas las actividades relacionadas con él. Se ha suscrito un contrato de financiamiento entre el BMZ y la MAPP/OEA.
Desde 2015, la contribución financiera se deposita directamente en este fondo de canasta (basket fund). En 2018, el aporte alemán alcanzó un millón de euros. Con ello, la totalidad del aporte alemán desde que se inició el proyecto en 2008 asciende a 6,5 millones de euros.

Impactos
La misión se ha posicionado como actor estratégico en el proceso de la construcción de paz local, regional y nacional. Su trabajo está valorado mucho por el gobierno colombiano, lo cual se demuestra en el prolongamiento de su mandato. En el mandato actual, el trabajo de la misión se concentra en los tres temas siguientes, en los cuales se ha podido lograr progresos considerables.
Construcción de Paz:
Víctimas individuales y colectivos del conflicto armado (especialmente comunidades étnicas y pequeños/as campesinos/as) obtienen un mejor acceso a sus derechos de restitución de tierras y de reparación.
Instituciones estatales e iniciativas locales son fortalecidas en temas de memoria histórica y la transformación pacífica del conflicto.
Organizaciones de la sociedad civil participaron en las negociaciones del gobierno colombiano y el grupo guerrillero Ejército de Liberación Nacional (ELN). La misión ha tenido un papel determinante en la elaboración de este método participativo.
Justicia Transicional:
Las instituciones estatales encargadas con la Justicia Transicional disponen de herramientas concretas para la implementación del Sistema Integral de Verdad, Justicia, Reparación y No Repetición, así como de recomendaciones para el cierre del proceso bajo la Ley de Justicia y Paz. A esto, la misión ha contribuido mediante observaciones importantes y recomendaciones para la realización de las herramientas de la Justicia Transicional y la criminalidad a nivel macro.
En cinco espacios de dialogo para la Coordinación Interjurisdiccional a nivel nacional, comunidades indígenas e instituciones estatales discuten el fortalecimiento y la aplicación de la jurisdicción indígena, así como su armonización con la justicia ordinaria y la justicia transicional.
Desarrollo y dinámicas territoriales:
La institucionalidad colombiana mejora el abordaje de las condiciones de seguridad regionales en los territorios, donde la MAPP/OEA hace presencia. Además, la institucionalidad colombiana es fortalecida en el conocimiento de conflictividades sociales y territoriales, y desarrolla estrategias más efectivas para la atención y gestión de estas conflictividades. Ambos de estos progresos son posibles gracias a los informes de análisis y monitoreo continuos, que la misión elabora para las regiones en donde hace presencia.
